1. No Right of Withdrawal for Personalised Products

There is no right of withdrawal for contracts for the supply of goods made to the consumer’s specifications or clearly personalised (Section 312g(2) No. 1 BGB). This especially covers our custom RepliToy figures/objects created based on your inputs (e.g., photos/logos/texts) in a stylised, artistic manner.

2. Withdrawal for Non-Personalised Goods

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you (who is not the carrier) takes possession of the goods.

Exercising your right. To exercise the right of withdrawal, you must inform us (expertpal UG (haftungsbeschränkt), Nettelbeckstr. 15, 40477 Düsseldorf, Germany, [email protected]) of your decision to withdraw by means of a clear statement (e.g., e-mail or letter). You may use the model withdrawal form below, but it is not mandatory. To meet the deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw, we will reimburse all payments received, including delivery costs (except additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise; you will not be charged fees for the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest. You must send back or hand over the goods without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

3. Withdrawal for Digital Content (not supplied on a tangible medium)

For contracts for digital content supplied not on a tangible medium (e.g., downloads/templates), the withdrawal period is 14 days from contract conclusion. Expiry notice: Your right of withdrawal expires prematurely if we begin performance before the end of the withdrawal period after you have explicitly consented to the start of performance and confirmed your knowledge that you lose your right of withdrawal once performance starts; we will provide confirmation on a durable medium.

4. Withdrawal for Services/SaaS/Software

For services (including SaaS/online tools) you have a 14-day withdrawal period from contract conclusion. Expiry notice: The right expires if the service has been fully performed and we started performance only after your express consent and your confirmation that you lose your right of withdrawal upon full performance.

5. Other Statutory Exclusions/Expiry (Overview)

The statutory exclusions/expiry grounds remain unaffected (e.g., sealed goods not suitable for return for health/hygiene reasons once unsealed; goods inseparably mixed with other items after delivery). Items like newspapers or market-dependent goods apply only where relevant to our range.

6. Marketplace Orders (e.g., Etsy)

For marketplace purchases, the platform’s return/withdrawal rules may additionally apply to procedural steps (e.g., request channels, labels, deadlines). The exclusion of withdrawal for personalised goods remains unchanged.
